Bird Marella attorneys Ariel Neuman and Julian Burns authored the article, “Backpage Dismissal Does Not Solve Websites’ Woes,” published by Law360. The article analyzes the implications of a recent ruling by a California Judge to dismiss all criminal charges against the website based on immunity granted to website operators by the Communications Decency Act (CDA).  They consider whether that immunity truly protects website operators from being liable for third-party content, or whether an exception to that immunity leaves too large a loophole.

Mr. Neuman and Ms. Burns provide an in-depth analysis of the CDA, present past examples of prosecutors and plaintiffs successfully finding ways to pursue website operators, and detail the broader implications of the decision and how it will affect website owners going forward.
