Bird Marella attorneys Elliot Harvey Schatmeier and Kimmy Yu successfully defended real estate brokerage Compass in an arbitration brought by two former real estate agents in the Napa region asserting claims for breach of contract, fraud, violations of Labor Code sections, and violations of California Business & Professional Code Section 17200. Claimants alleged that Compass failed to honor promises allegedly made during the recruitment process, denied them commissions for listings they could have obtained, made material misrepresentations to them about Compass’s stock option programs, and improperly sought repayment of incentives under the Independent Contractor Agreements.
The arbitrator found for Bird Marella’s client and rejected all of the Claimants’ claims, awarding them nothing after they initially sought $10 million in damages.
This marks the second complete defense victory and third overall win that Bird Marella secured for Compass in less than 12 months, including another multimillion-dollar artibitration win and the dismissal of a federal trade secrets dispute.
