Bird Marella partner Oliver Rocos and senior associate Darren Patrick won a contractual dispute in a bench trial in the Southern District of New York on behalf of their third-party logistics company client, which services apparel and home furnishings retailers nationwide.
The case began as a relatively minor disagreement over the appropriate storage rate, but quickly escalated into a hard-fought dispute involving more than $1 million in warehousing charges tied to goods valued between $5 million and $10 million. The defendants further asserted counterclaims valued at over $15 million.
In a ruling issued this week, the court awarded Bird Marella’s client over $1.6 million in damages. Mr. Rocos and Mr. Patrick also successfully defeated all the defendant’s counterclaims.
